Calculation of damage arising from a work accident or occupational disease
Every year work accidents happen in Aruba. Such accidents can result in permanent injury, and in some cases, victims die. In addition, people could die every year as a result of occupational diseases. It goes without saying that an employer will not be liable if someone deliberately caused their own accident or acted recklessly. In terms of damage arising from a work accident or occupational disease, a distinction is made between material and emotional damage. Nearly all Aruban employers are insured against work accidents and occupational diseases.

In addition, the victim may be entitled to compensation for emotional damage, including pain and loss of amenities. The amount of any such compensation will, of course, depend on such factors as the type of injury, ensuing limitations, age, and occupation.
